Terms of Service

1. Acceptance of Terms

By accessing or using the QFS Wallet website, mobile applications, or any services provided by QFS Wallet ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all users of our services, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Eligibility

By using our services, you represent and warrant that:

• Age: You are at least 18 years old or the age of majority in your jurisdiction
• Legal Capacity: You have the full power and authority to enter into these Terms
• Compliance: Your use of our services does not violate any applicable laws or regulations
• Residency: You are not a resident of any country where our services are prohibited by law
• Sanctions: You are not on any sanctions lists (OFAC, UN, EU, etc.)

3. Account Registration

To use certain features of our services, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept all risks of unauthorized access to your account
• Notify us immediately of any security breach

Account Types

4. Security Obligations

You are responsible for maintaining adequate security and control of any and all passwords, API keys, private keys, and other credentials associated with your use of our services.

Your Responsibilities:

• Enable two-factor authentication (2FA) on your account
• Use strong, unique passwords
• Never share your private keys or recovery phrases
• Keep backup copies of recovery phrases offline
• Log out after each session

While we implement industry-leading quantum security measures, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures. You acknowledge that you provide your information at your own risk.

5. Prohibited Activities

You may not use our services for any illegal or unauthorized purpose. Prohibited activities include:

• Illegal Activities: Money laundering, terrorist financing, fraud, or any criminal activity
• Sanctions Violations: Transacting with sanctioned individuals or entities
• Market Manipulation: Wash trading, spoofing, or price manipulation
• Abusive Conduct: Harassment, threats, or intimidation of users or staff
• Intellectual Property: Infringing on any patents, trademarks, or copyrights
• System Abuse: Attempting to interfere with, compromise, or disrupt our systems
• Automated Access: Using bots, scrapers, or automated systems without permission

6. Fees & Payments

QFS Wallet charges fees for certain services. By using these services, you agree to pay the applicable fees.

Fee Schedule

Fees are subject to change with 30 days notice. Network fees (gas fees) are determined by the respective blockchain and are not controlled by QFS Wallet.

7. Intellectual Property

The QFS Wallet platform, including but not limited to its software, design, text, graphics, logos, and trademarks, is owned by QFS Wallet and protected by intellectual property laws.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use our services for their intended purpose, subject to these Terms.

Restrictions

You may not:

• Copy, modify, or create derivative works of our platform
• Reverse engineer, decompile, or disassemble our software
• Remove any copyright or proprietary notices
• Use our trademarks without written permission

8. Privacy & Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our services, you consent to our data practices described in the Privacy Policy.

Key privacy points:

• We collect minimal personal information necessary for service operation
• We do not sell your personal data to third parties
• We use cookies and similar technologies as described in our Cookie Policy
• You may request deletion of your personal data subject to legal requirements

9. Limitation of Liability

To the maximum extent permitted by law, QFS Wallet and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions, errors, or security breaches beyond our reasonable control
• Actions taken by third parties, including hackers or cybercriminals
• Your failure to secure your account credentials or private keys

Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless QFS Wallet (Qfs System) and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit
• Your violation of any applicable laws or regulations

11. Termination

We may terminate or suspend your account and access to services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Grounds for Termination:

• Violation of these Terms or our policies
• Suspected illegal or fraudulent activity
• Request by law enforcement or government agency
• Extended periods of inactivity
• Upon your request

Upon termination, your right to use the services will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the Swiss Rules of International Arbitration. The arbitration shall be conducted in Geneva, Switzerland.

Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the services.
